This survey may be used for purchase evaluation, insurance, or mortgage requirements. It will be conducted utilizing various standards and recommended practices for Small Crafts as criteria including current portions of those used by the American Boat and Yacht Council (ABYC) and The National Fire Protection Agency (NFPA 302) during the examination of this Vessel.
I understand that this survey does not imply a guarantee or Warranty. This report is a statement of the apparent condition, a list of recommendations and “Fair Market Value” at the time of the survey only.
This survey is an honest and unbiased opinion of the surveyor Based solely on the examination of the readily available areas of the vessel and not of the areas inaccessible due to bulkheads, fastenings, etc. It does not address the internal condition or performance abilities of any mechanical, hydraulic, or electrical device, unless otherwise stated herein. There will be no disassembly of machinery, plumbing, wiring, or other part, components or system for inspection.
Any Liability that results from the use of this Survey Report is limited to and shall not exceed the charges for services rendered by Dennis Biel Marine Surveyors LLC. Under no circumstances shall the report be understood to constitute a guarantee, warranty expressed or implied, of any kind. The Survey report is not valid until the fee for survey is paid in full.
Attorney fees and cost of any litigation arising out of this contract, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs. The venue for litigation shall be in Macomb County, Michigan.
The undersigned Dennis Biel Marine Surveyor LLC shall carry no liability for property loss damages, and no liability for punitive damages, all of which shall be deemed to have knowingly and voluntarily waived upon the use of this report; further, in no event shall the legal liability of the undersigned even exceed the fee paid by the requesting party for issuance of this report, regardless of the number of claims or suits and regardless of whether under theory of tort, contract, warranty, products, outrage, or otherwise
Payment is to be made in US Dollars on or before the day of the survey; out of state/Country checks are to be certified, or payment can be made by Credit card. Reports are prepared no later than five working days after the survey.
